TERMS OF SERVICE
Welcome to Choice Eyewear.
These Terms of Service ("Terms") govern your use of choiceeyewear.com (the "Site"), your interactions with Choice Eyewear, and purchases or orders submitted to Choice Eyewear through our Site, by mail, through a correctional facility or other institution, through an authorized representative, or through another ordering method accepted by us.
Throughout these Terms, "Choice Eyewear," "we," "us," and "our" refer to Choice Eyewear.
By accessing or using our Site, creating an account, submitting an order, or purchasing products from us, you agree to these Terms and to the policies incorporated into them, including our Privacy Policy, Shipping Policy, and Refund, Return & Remake Policy.
Please review these Terms before using our Services or submitting an order.
1. ONLINE STORE TERMS
You must have legal authority to make a purchase or submit an order.
If you are under the age of majority in your jurisdiction, a purchase must be made or authorized by a parent, legal guardian, institution, or other person authorized to act on your behalf where permitted by law.
You may not use our Site, Services, products, ordering systems, or communications for an unlawful, fraudulent, abusive, or unauthorized purpose.
You may not attempt to interfere with, damage, disrupt, gain unauthorized access to, manipulate, or misuse our Site, checkout, accounts, promotions, applications, integrations, databases, or related systems.
2. PRODUCTS & PRODUCT INFORMATION
We make reasonable efforts to provide accurate information about our products, including:

• Materials
• Frame specifications
• Lens options
• Images
• Availability
• Pricing
Actual product appearance may vary due to factors such as:
• Lighting
• Photography
• Screen or display settings
• Manufacturing variations
• Material variations

• Lens treatments or coatings
Colors shown online or in printed materials are intended to be representative and may not appear identical in every environment.
Product availability, designs, materials, specifications, pricing, lens options, and other offerings may change.
We may discontinue a product or limit quantities when reasonably necessary.
3. PRESCRIPTION & CUSTOM EYEWEAR
Prescription eyewear is manufactured according to information submitted or otherwise confirmed for an order.
The person submitting an order is responsible for providing complete and accurate information, which may include:
• Prescription values
• Sphere (SPH)
• Cylinder (CYL)
• Axis
• ADD
• Prism
• Pupillary distance (PD)
• Frame selection
• Lens selection
• Tint selection
• Coatings
• Measurements
• Shipping information
• Other customization instructions
By providing prescription information, you represent that:
• the prescription belongs to the intended wearer; or
• you are authorized to provide the prescription on behalf of the intended wearer.
Choice Eyewear may rely upon prescription and order information supplied by:
• the customer;
• the intended wearer;
• a parent or guardian;
• an authorized representative;
• a correctional facility or other institution;
• an eye-care professional; or
• another person reasonably authorized to submit the information.
Choice Eyewear is not responsible, to the extent permitted by applicable law, for manufacturing issues caused by inaccurate, incomplete, outdated, illegible, or incorrectly submitted information provided to us.
However, if information was correctly submitted and Choice Eyewear manufactures or processes the order differently from the information properly submitted and accepted for that order, the matter will be handled under our Refund, Return & Remake Policy and applicable law.
Prescription lenses and other customized products are made specifically for an individual order and therefore may have different cancellation, return, exchange, refund, or remake eligibility from non-custom products.
Customers and ordering parties should review order confirmations and documentation promptly and contact us as soon as possible if information appears incorrect.
Once production has begun, changes may not be possible.
Nothing in this section limits consumer rights or remedies that cannot legally be waived.
4. MAILED, CORRECTIONAL & INSTITUTIONAL ORDERS
Choice Eyewear may accept orders submitted by:
• Mail
• Correctional facilities
• Government institutions
• Other institutions
• Family members
• Authorized representatives
• Other ordering methods approved by Choice Eyewear
These orders may include paper forms, prescriptions, institutional documents, payment documentation, correspondence, and related materials.
The person or entity submitting the order is responsible for providing information that is reasonably complete, accurate, and legible.
Information may include:
• Customer or recipient name
• Inmate, offender, resident, or institutional identification number
• Institution name
• Facility address
• Housing or delivery information
• Prescription
• Frame selection
• Lens selection
• Customization options
• Payment amount
• Payment reference
• Check or money-order information
• Other information reasonably necessary to fulfill the order
We may contact the customer, ordering party, institution, representative, or other appropriate person when clarification is reasonably necessary.
If information cannot reasonably be verified, we may delay processing until the issue is resolved.
5. DIGITAL DOCUMENT PROCESSING, AUTOMATION & AI-ASSISTED TOOLS
Choice Eyewear may digitize, scan, photograph, upload, transcribe, organize, extract, or otherwise electronically process information contained in paper or electronic documents submitted in connection with an order.
We may use technologies such as:
• Optical character recognition ("OCR")
• Automated data-entry systems
• Workflow automation
• Artificial intelligence-assisted technologies
• Document-processing software
• Ecommerce integrations
• Other administrative technology
These technologies may assist Choice Eyewear and our authorized personnel or contractors with activities such as:
• Reading order forms
• Transcribing information
• Organizing order data
• Entering information into ecommerce systems
• Creating draft order records
• Matching payments to orders
• Identifying missing information
• Identifying potentially unclear information
• Preparing order documentation
• Administrative processing
• Order verification
Automated and AI-assisted technologies are administrative tools.
They are not intended to:
• prescribe eyewear;
• provide medical advice;
• diagnose eye conditions;
• replace an eye-care professional; or
• independently determine what prescription a customer should receive.
Choice Eyewear may use authorized personnel to review information processed using automated systems.
Where prescription values, payment information, handwriting, product selections, measurements, or other material order information appears unclear, incomplete, contradictory, or uncertain, we may require additional review or verification before fulfillment.
Choice Eyewear's use of automated technologies does not change the prescription supplied by the customer or authorized ordering party.
Our Privacy Policy describes how personal information may be processed through these systems.
6. ORDER VERIFICATION & UNCLEAR INFORMATION
We may review an order before production or fulfillment.
Additional review may occur when:
• handwriting is unclear;
• prescription values appear incomplete;
• required measurements are missing;
• information on multiple documents conflicts;
• an order selection is ambiguous;
• the payment amount does not match the expected order total;
• an institutional reference cannot be matched;
• a prescription appears incomplete;
• information appears to contain a transcription or data-entry issue; or
• other information reasonably requires clarification.
Depending on the circumstances, we may:
• manually review the original document;
• request clarification;
• request additional documentation;
• contact the customer or ordering party;
• contact an authorized representative or institution;
• place the order on temporary hold;
• correct an internal transcription error after verifying the original documentation; or
• cancel the order if it cannot reasonably be fulfilled.
Choice Eyewear's review procedures are intended as an additional operational safeguard.
The existence of a review process does not relieve customers or ordering parties of responsibility for submitting correct information.
7. PAYMENT BY CHECK, MONEY ORDER & INSTITUTIONAL PAYMENT
Choice Eyewear may accept approved forms of non-electronic payment, including checks, money orders, institutional payments, fiduciary-account payments, and other payment methods we choose to accept.
Payment documents may be used to verify:
• Payment amount
• Payment date
• Payment source or issuer
• Check number
• Money-order number
• Institutional payment reference
• Customer or institutional identification information
• Payment status
We may record reasonably necessary payment-reference information in our ecommerce, accounting, customer-service, receipt, or order-management systems.
We may also include appropriate payment-reference information on receipts, invoices, packing slips, or other documents where useful for institutional or customer recordkeeping.
We seek to avoid unnecessarily reproducing financial account credentials when they are not needed for order processing.
Receipt of a check, money order, or other payment document does not necessarily constitute final acceptance of an order.
We may delay fulfillment while payment or order information is verified.
If payment does not correspond to the order total, we may contact the ordering party, place the order on hold, adjust the order with authorization where appropriate, return payment where reasonably necessary, or take another reasonable action consistent with applicable law.
8. PRICES & PRICE CHANGES
Prices may change from time to time.
Changes generally apply to future orders and do not ordinarily change the price of an order already accepted by Choice Eyewear.
We may change:
• Product prices
• Lens prices
• Add-on prices
• Promotions
• Discounts
• Shipping charges
• Free-shipping thresholds
• Product offerings
Pricing remains subject to correction of genuine errors as described below.
9. PRICING, CHECKOUT & TECHNICAL ERRORS
Although we make reasonable efforts to maintain accurate prices and information, errors can occur.
Errors may arise from:
• Typographical mistakes
• Software problems
• Application errors
• Integration errors
• Incorrect configurations
• Cached or outdated information
• Automation failures
• System malfunctions
• Human error
• Other unintended circumstances
Examples may include:
• Incorrect prices
• Unintended discounts
• Incorrect promotional offers
• Incorrect shipping charges
• Incorrect free-shipping thresholds
• Incorrect taxes
• Incorrect inventory
• Duplicate discounts
• Incorrect quantities

• Products incorrectly displayed as free or substantially below their intended price
To the extent permitted by applicable law, we may correct genuine errors and decline, modify, or cancel affected orders.
This may occur after an order has been submitted or after an automated confirmation has been issued.
When reasonably appropriate, we may notify the customer of the corrected information and allow the customer to proceed under the corrected terms.
If an affected order is canceled after payment has been collected, we will refund the applicable amount for the canceled portion.
Nothing in this section permits Choice Eyewear to disregard applicable pricing or consumer-protection laws.
10. ORDER SUBMISSION & ACCEPTANCE
Submitting an order constitutes a request or offer to purchase the applicable products.
An automated confirmation generally confirms that we received the order. It does not necessarily mean the order has completed all verification or has been finally accepted for production.
Choice Eyewear may review an order before fulfillment.
Subject to applicable law, we may decline, hold, modify with appropriate authorization, or cancel an order when reasonably necessary because of:
• Pricing or promotional errors
• Technical errors
• Fraud concerns
• Unauthorized payment activity
• Inability to verify payment
• Incomplete order information
• Product unavailability
• Duplicate orders
• Promotion abuse
• Unauthorized resale
• Unclear prescription information
• Missing measurements
• Institutional restrictions
• Shipping restrictions
• Other circumstances that reasonably prevent fulfillment
If an order is canceled after payment has been collected, the applicable payment will be refunded or otherwise handled according to the payment method and circumstances.
11. PROMOTIONS, DISCOUNTS & STORE CREDITS
Promotions, discounts, promotional codes, store credits, and special offers may have conditions such as:
• Eligibility requirements
• Exclusions
• Minimum purchase amounts
• Expiration dates
• Quantity limits
• Product limitations
• One-time-use restrictions
Unless expressly stated otherwise, promotions may not be combined.
We may reject transactions involving:
• Fraudulent promotion use
• Unauthorized distribution of codes
• Manipulation of promotional systems
• Duplicate use
• Unintended stacking
• Abuse of promotional offers
If a promotion is applied incorrectly because of a genuine technical or system error, the pricing-error provisions of these Terms apply.
12. SHIPPING & DELIVERY
Available shipping methods, delivery destinations, shipping charges, carriers, and free-shipping requirements may change.
Applicable shipping information is provided through our Shipping Policy, checkout, institutional ordering materials, or other documentation.
Delivery times are estimates unless expressly stated otherwise.
Delays may occur because of:
• Carrier operations
• Weather
• Customs
• Government action
• Correctional-facility processing
• Institutional mail procedures
• Security screening
• Incorrect or incomplete addresses
• Facility transfer
• Circumstances outside our reasonable control
Correctional facilities and other institutions may impose their own delivery, packaging, product, frame, lens, or mailroom restrictions.
Choice Eyewear is not responsible for delays caused solely by institutional intake, screening, mailroom processing, facility transfers, or other procedures outside our reasonable control.
Customers and ordering parties are responsible for providing the correct authorized delivery address and any required identification information.

13. CORRECTIONAL FACILITY & INSTITUTIONAL RESTRICTIONS
Correctional facilities and other institutions may maintain rules concerning permitted:
• Frames
• Frame colors
• Frame materials
• Lens materials
• Lens colors
• Tints
• Coatings
• Accessories
• Packaging
• Shipping methods
• Documentation
These requirements vary by institution and may change.
The customer or ordering party is responsible for reviewing applicable institutional requirements when the institution makes those requirements available to them.
Choice Eyewear may also rely on institutional rules or information provided to us.
If we reasonably determine before fulfillment that a selected product is prohibited or unsuitable under known institutional requirements, we may contact the ordering party regarding available alternatives.
Choice Eyewear cannot guarantee that an institution will accept every product or shipment when institutional policies change or when restrictions were not reasonably known to us at the time the order was processed.
14. RETURNS, EXCHANGES, REMAKES & REFUNDS
Returns, exchanges, cancellations, remakes, refunds, and store credits are governed by our Refund, Return & Remake Policy.
Prescription eyewear and other customized items may have different eligibility requirements because they are manufactured to customer-specific specifications.
Nothing in our return or refund policies limits rights that cannot legally be waived.
15. BILLING & ORDER INFORMATION
You agree to provide information that is reasonably complete and accurate when placing an order.
This may include:
• Billing information
• Shipping information
• Prescription information
• Measurements
• Contact information
• Institutional information
• Product selections
We may request additional information when reasonably necessary to:
• Verify an order
• Verify payment

• Identify the intended recipient

Providing a telephone number in connection with an order does not by itself constitute consent to receive marketing text messages.

you represent that you have the right to submit the content and that your submission does not violate applicable law or another person's rights.
If you submit content for publication or promotional use, you grant Choice Eyewear a non-exclusive, worldwide, royalty-free license to reproduce, display, format, and use that content in connection with Choice Eyewear's website, products, social media, advertising, and marketing, subject to applicable law.
We may decline or remove content that we reasonably believe is:
• Fraudulent
• Abusive
• Misleading
• Unlawful
• Infringing
• Inappropriate
Do not include confidential prescription information, institutional identification numbers, financial information, or other sensitive personal information in public reviews.
23. INTELLECTUAL PROPERTY

We do not guarantee that online systems will operate without interruption or technical error.
Products remain subject to applicable warranties and consumer protections that cannot legally be excluded.
Nothing in these Terms excludes or limits warranties or consumer rights that cannot lawfully be waived.
28. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Choice Eyewear and its officers, employees, affiliates, contractors, service providers, suppliers, and agents will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of our Site or Services.
Any limitation or exclusion applies only to the extent permitted by applicable law.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.
29. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Choice Eyewear and its affiliates, officers, employees, contractors, and service providers from third-party claims arising from:
• Your unlawful use of the Services
• Your material violation of these Terms
• Your infringement of another person's rights
This provision does not require indemnification where prohibited by applicable law.
30. FORCE MAJEURE
Choice Eyewear will not be responsible for delays or failures caused by circumstances outside our reasonable control.

Nothing in this section limits rights that cannot legally be waived.
31. TERMINATION & REFUSAL OF SERVICE
We may suspend or terminate access to our Site or Services, or decline future transactions, when we reasonably believe a person has:

• Engaged in fraud
• Engaged in unlawful activity
• Threatened or harassed our personnel
• Attempted to interfere with our systems
• Materially misused our Services
Any termination does not eliminate obligations or liabilities that arose before termination.
We may also decline an order that cannot reasonably be fulfilled because of prescription, payment, product, shipping, or institutional requirements.
32. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed as necessary.
The remaining provisions will continue in effect.
33. NO WAIVER
If Choice Eyewear does not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce that provision later.
34. ENTIRE AGREEMENT
These Terms, together with policies expressly incorporated into them, constitute the agreement governing use of our Site and purchases from Choice Eyewear unless additional terms are separately agreed to.

35. GOVERNING LAW

Nothing in this section deprives a consumer of protections or rights that cannot legally be waived.
36. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in:
